Terms of Use

Welcome to Bundle. These Terms of Use (“Terms”) govern your use of our property management platform. Please read them carefully. In these Terms:

"Service" means the Bundle platform.

"User" means anyone who creates an account or accesses the Service.

"Property" and "Property Bundle" each mean the digital record set for a real-world property held within the Service, including its records, files, notes, access permissions, privacy settings, AI interactions, metadata, and related information. These Terms may use those terms interchangeably.

"Property Record" means the records, files, notes, metadata, and other content held within a Property.

Where these Terms refer to the real-world property itself — such as physical safety, hazards, legal compliance, physical condition, or legal ownership of real estate — that meaning is stated expressly.

"Owner" means a User who controls a Property.

"Admin" means a User granted administrative access to a Property, including the ability to manage access, change privacy settings, and view private records.

"Contributor" means a User who may add records or contributions but cannot delete content or manage access.

"Viewer" means a User who may view permitted records but cannot add, delete, or manage access.

"Professional" means a person or entity using Bundle in a business, trade, or professional capacity, or a User who activates or is required to activate a Professional subscription because of their use of the Service. This may include accessing more than one Property shared with them or otherwise external to their own ownership, or electing to retain an Archive Copy during a transfer.

“Archive Copy” means a separate archive copy of a Property Record made available under a Professional’s account in connection with a transfer, where the Professional created the relevant Property, elects to retain a copy during the transfer process, and has the required Professional subscription (see §4.2A/§7).

1. Agreement to Terms

1.1 Acceptance

By creating an account or using Bundle, you agree to these Terms of Use and our Privacy Policy. If you are using Bundle on behalf of another person or entity, you represent that you have authority to bind them to these Terms. You are responsible for accurately declaring your relationship to any property you set up, access, or manage in Bundle. Bundle may rely on your relationship to a property and your use of particular features to determine applicable pricing, billing, permissions, available features, transfer behaviour, Archive Copy eligibility, and how property data is processed, retained, and shared between users. Providing inaccurate information about your relationship to a property may affect your access.

All users sign up through the same account flow. Certain actions — such as accessing more than one Property Bundle shared with you or external to your own ownership, or electing to retain an Archive Copy during a transfer — require a Professional subscription. Where an action requires a Professional subscription, we will tell you before you take it and you must opt in. No Professional subscription or associated fee applies unless you accept it at that point. If you choose not to opt in, that action will not be available to you, but your existing access is unaffected.

1.2 Eligibility

You must be at least 16 years old to use Bundle. If you are under 18, you should have parental or guardian consent.

1.3 Account Registration

  • You may register one or more properties under your account
  • You must provide accurate, complete information
  • You are responsible for maintaining account security
  • You must notify us immediately of any unauthorised access

1.4 Changes to Terms

We may modify these Terms by posting updates on our website or notifying you by email. Material changes (including modifications to data use practices, pricing structure, core functionality, or liability provisions) will be communicated with 30 days' notice by email or dashboard notification. Unless stated otherwise, other changes take effect immediately. Your continued use constitutes acceptance of modified Terms.

1.5 Communications

You agree we may send you service and transactional communications (e.g. security alerts, billing, product updates) in connection with your account. We will only send you marketing communications where you have given valid consent, and you can withdraw consent at any time using the unsubscribe link or by contacting us.

2. The Service

2.1 What Bundle Provides

Bundle is a property documentation and management platform offering:

  • Secure document storage and organisation
  • AI-powered search, chat, analysis, property insights, recommendations, summaries, schedules, and other property-related outputs generated from your Property Record, where available
  • Maintenance task management, reminders, tracking, scheduling workflows, or similar structured maintenance features, where enabled
  • Logged access to property information (see §3.4)
  • A mechanism for Professionals to offer new documents from their Archive Copy to Owners as Update Proposals, which Owners can review, accept, or decline (see §4.2B).
  • Entry, storage, and organisation of property-related service contact information, where enabled, such as tradespeople, service providers, and other relevant property contacts.
  • Where enabled, certain service contacts may be marked as connected and granted ongoing access.
  • Inbound email attachment ingestion from senders the account has authorised and the Service has verified, where enabled
  • Additional features as we develop them

2.2 AI Services Disclaimers

Our AI features assist with property management but have important limitations:

  • AI outputs are not substitutes for professional advice (legal, engineering, financial, or otherwise)
  • AI-generated content may contain errors or inaccuracies
  • You must independently verify all important information
  • You are solely responsible for decisions regarding your property
  • For emergencies, contact appropriate authorities directly - Bundle may provide contact information but is not an emergency service

2.3 Service Availability

We strive to maintain Service availability but cannot guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

2.4 Automated Processing

We don’t pre-screen or manually review what you upload. You and anyone you share access with are responsible for the content added. We may remove or restrict content that breaches these Terms or the law, or where required to do so.

We do automatically process uploads, for example, storing them and converting them into searchable formats, so that features such as search and AI answers work. These processes are technical, not supervisory, and aren’t used to monitor what you upload.

Where you submit feedback or rate an AI output, the content of that exchange — including the prompt, the response, and related context — may be reviewed by our team to diagnose issues and improve the Service. This is distinct from the automated processing described above.

2.5 Property Safety and Compliance

Bundle helps you organise and access records relating to your real-world property. We are not responsible for monitoring the real-world property for hazards, safety, legal compliance, or physical condition, and we do not report issues to councils or authorities on your behalf. For emergencies or compliance advice, please contact the relevant professionals or authorities directly.

For properties involving a body corporate, shared ownership, shared services, or common property, Bundle does not determine who is responsible for maintenance, repairs, disclosure, levies, insurance, or compliance obligations.

3. Acceptable Use

3.1 Permitted Use

You may use Bundle solely for lawful purposes related to property documentation and management.

3.2 Prohibited Conduct

You must not:

  • Violate any applicable laws or regulations;
  • Impersonate others or provide false information;
  • Attempt unauthorised access to any accounts or systems;
  • Interfere with or disrupt the Service;
  • Upload content that infringes third-party rights;
  • Upload harmful, offensive, or malicious content;
  • Reverse engineer, copy, or scrape the Service; or
  • Resell or commercially exploit the Service without authorisation

3.3 Property access and sharing

Property Bundles may support different access roles, such as Owner, Admin, Contributor, and Viewer.

The Owner is responsible for deciding who may access a Property and what level of access they should have. Owners and Admins should only grant access to people they trust and should review permissions regularly.

Only the Owner can transfer ownership of a Property Bundle. Other user roles may be able to view records, add records, manage access, change privacy settings, or perform other actions only where their assigned role allows.

Users may be given access by invitation, QR request approval, or other access methods made available through the Service. Access may require identifying details, at minimum name and email, and is logged in accordance with §3.4. Users given access must accept Bundle’s Terms of Use and Privacy Policy before accessing a Property.

You are responsible for the access roles you assign, the permissions you grant, and the consequences of sharing property information with other users. Bundle cannot prevent an authorised user from copying, saving, screenshotting, forwarding, or otherwise disclosing information they were permitted to access.

Private and shared records

The Service may allow records, files, notes, or other content to be marked as private.

Unless a record is marked private, it may be visible and retrievable by users who have access to the relevant Property Bundle, subject to their access role and the Service settings.

Private records are hidden from users who are not the Owner or an Admin for the relevant Property Bundle. This applies both to ordinary record views and to retrieval through AI chat, search, or similar features.

Private status can be applied or changed only by users whose permissions allow it, such as Owners and Admins. If a private record is changed to shared or non-private, it may become visible to users whose access role allows it. If a shared or non-private record is later changed to private, that change restricts future access within the Service but does not undo access that may already have occurred, including viewing, downloading, copying, screenshotting, AI responses, or disclosure outside the Service.

“Private” is a visibility setting within Bundle. It does not prevent Bundle or its service providers from processing the record where necessary to provide, secure, maintain, support, or operate the Service in accordance with these Terms and the Privacy Policy.

Your Responsibilities

You remain responsible for:

  • Deciding what to share;
  • The identity of who you give access to;
  • Managing invitations, approvals, and revoking access when no longer appropriate;
  • The contributions and activities of users you give access to; and
  • Any disclosures you or your accessing users make.

Do not share access or upload content you do not want other people to see.

Where an account is used to represent an organisation or body corporate, the account holder is responsible for controlling who can access it, including when the responsible individual changes. Bundle treats actions taken through an account as authorised by the account holder.

3.4 Access Logging

For security and audit, we log access events (including name, email, timestamps and IP address, where available) and surface these logs to you where feasible.

3.5 Intellectual Property and Confidentiality

You must not upload content that infringes another person’s intellectual property rights or that breaches a duty of confidence or privacy. You warrant you have all necessary rights, licences and consents to upload and share the content you provide. You indemnify us against any claim, loss or cost arising from your breach of this clause.

3.6 Prohibited Content (Sensitive Information)

You must not upload or store the following types of information in Bundle:

  • health information (including medical histories, diagnoses, test results)
  • personal financial information (including full payment card numbers, CVV/CVC codes, bank account numbers and online banking credentials);
  • security system information (including alarm panel PINs, safe combinations, smart-lock PINs, camera/NVR admin passwords, or similar credentials);
  • government-issued identifiers not required for the use of the Service (e.g., full passport or driver licence numbers).

If you upload any Prohibited Content, you do so at your own risk, we may remove it, and we aren’t responsible for any resulting loss. Uploading or sharing security credentials (e.g., alarm or lock codes) may increase risk or affect insurance coverage - check your policy before storing such information in any online service.

4. Data

4.1 Data Ownership

You retain ownership of all data you upload to Bundle, including property records, documents, contact records, notes, and other content. We claim no ownership rights to your documents, images, or information.

4.2 License to Bundle

You grant us a license to use, store, process, and analyse your data solely to:

  • Provide and maintain the Service
  • Generate property-specific insights and recommendations
  • Create anonymised, aggregated analytics as described in Section 4.3
  • Comply with legal obligations

4.2A Property Copying (Archive Copies)

Where a Professional elects to retain an Archive Copy during a Property Bundle transfer, has the required Professional subscription, and has created the relevant Property Bundle, Bundle will make a separate archive record available under the Professional’s account to support the Professional’s record-keeping and compliance obligations.

Each copy is processed, stored, and managed independently. Rights, responsibilities, retention, access, and deletion requests apply separately to each copy. Archive Copies follow the same sharing rules as other Property Bundles, but remain independent of the Owner’s Property Bundle. The Professional remains responsible for determining what records they are required or permitted to retain and for ensuring any sharing of personal information complies with applicable privacy laws.

4.2B Professional Update Proposals from Archive Copies

After a Property Bundle is transferred to a new Owner, a Professional who adds documents or records to their Archive Copy may offer selected items to the corresponding live Property Bundle linked to that Archive Copy as “Update Proposals”. The Professional chooses which items to offer. An item that is not offered remains in the Professional’s Archive Copy and is not made available through the Update Proposal mechanism unless the Professional later offers it. Items that are offered are made available for review by the then-current Owner of the corresponding Property Bundle or an authorised Admin.

  • Offer-Only: Update Proposals are optional offers. They do not modify the Owner’s Property Record unless and until accepted by an Owner or authorised Admin.
  • Owner Control: The then-current Owner of the corresponding Property Bundle, and any authorised Admins, where permitted by the Service, may review, accept, decline, or ignore any Update Proposal. Update Proposals are visible only to users authorised to review them. Accepted items are added to the corresponding Property Bundle as new records using the visibility settings selected or applied during acceptance.

Declined items are not added and no further action is taken.

  • No Synchronisation: Archive Copies and Owner Property Records are not synchronised. Uploads made to an Archive Copy are not automatically added to any Owner’s Property Record without acceptance. A privacy setting within a Professional’s Archive Copy does not automatically determine the visibility of a record in the Owner’s Property. Visibility in the Owner’s Property is determined by the Service settings and by the Owner or authorised Admin during acceptance.
  • Professional Visibility of Owner Decisions: Professionals do not receive confirmation of whether an Owner or authorised Admin accepted or declined an Update Proposal. A file’s presence in an Archive Copy does not indicate that it was accepted into the Owner’s Property.
  • Audit Logging: We may internally log events for security, auditing, and regulatory compliance. These logs are internal to Bundle and not visible to either party unless required by law.
  • No Modification Rights: An Archive Copy is separate from the Owner’s Property Bundle and may support some of the same Service functions, subject to the Professional’s account, subscription, role, and the Service settings. Activity in an Archive Copy does not modify the Owner’s Property Record unless a specific Service feature allows this, such as an Update Proposal accepted by an Owner or authorised Admin. Professionals cannot modify, delete, or otherwise interact with an Owner’s Property Record unless given access.

4.3 Service Improvement

We may analyse usage patterns and create aggregated insights to improve Bundle for all users. This includes:

  • Anonymous usage analytics (features used, performance metrics)
  • Aggregated property trends that cannot identify individual users or properties
  • Service improvements based on collective patterns.

These anonymised insights become our property and may be used to enhance the Service.

4.4 Data Security

We implement industry-standard security measures to protect your data. However, no internet transmission is completely secure. You acknowledge the inherent risks and agree to maintain backups of critical documents. We will notify you of any material security breaches affecting your data. We will also notify you of any privacy breach that poses a risk of serious harm, and, where required, notify the Office of the Privacy Commissioner.

4.5 Your Responsibilities

You represent that:

  • You have rights to upload all property data;
  • Your data doesn't infringe third-party intellectual property rights or breach any confidentiality obligations;
  • You have necessary consents for any personal information included.
  • For unit title, body corporate, cross-lease, shared-access, or similar properties, you are responsible for ensuring you have the authority or consent needed to upload, store, use, and share any records relating to common property, shared assets, other owners, occupiers, tenants, the body corporate, or its managers.

4.6 Deletion

Deletion of Data depends on your access role. Owners and Admins may delete records and contributions within a Property, including content added by other users. Contributors and Viewers cannot delete content, including content they added themselves. Deleted items are permanently removed from the Service, subject to limited backup, audit, security, fraud prevention, legal, and retention requirements described in these Terms and our Privacy Policy. Where enabled, users with permission to contribute may add their own contributions, such as notes or documents.

5. Intellectual Property

5.1 Your Rights

  • You retain ownership of your data
  • AI outputs generated specific to your property belong to you

5.2 Bundle's Rights

  • We own the Service, including all software, design, and features
  • We retain rights to our proprietary algorithms, workflows, and methodologies for processing and presenting information
  • We own anonymised, aggregated insights derived from Service usage
  • You receive a limited license to use the Service while your account is active

5.3 Feedback

Any suggestions or feedback you provide may be used by us without obligation to you.

5.4 Notices of alleged infringement

If you believe content on the Service infringes your rights, email support@mybundle.app with details (including your contact info, the content URL/identifier, and why you believe it infringes). We may remove content and notify the uploader.

6. Fees and Payment

6.1 Pricing

Current fees are described on our pricing page. We may modify fees for using the service with 30 days' notice. Prices may vary by plan, product type, account type, and functionality used.

6.2 Payment Terms

  • Fees may include setup costs, recurring subscriptions, and other charges described in the Service or on our pricing page.
  • Users must subscribe to the billing product applicable to their role and use context.
  • All fees are in NZD unless otherwise specified
  • Payment is due as specified in our pricing information
  • Late payments may incur interest at standard commercial rates

6.3 Refunds

Refunds are provided as required by applicable law. If you are unhappy, please contact us first - we'd rather solve the problem than lose you as a user.

6.4 Professional subscription triggers

Some actions require an active Professional subscription.

These currently include:

  • accessing more than one Property Bundle shared with you or otherwise external to your own ownership; or
  • electing to retain an Archive Copy during the transfer of a Property Bundle you created.

Before you take any such action, the Service will notify you that it requires a Professional subscription and give you the choice to opt in. We will not apply a Professional subscription or charge you a Professional fee unless you accept it at that point. If you do not opt in, the action is simply unavailable; nothing you can already access is restricted or removed.

Archive Copies are only available where the transferring user created the relevant Property Bundle and elects to retain an Archive Copy during the transfer process.

Professional subscription requirements may affect access to Professional features, Archive Copies, Update Proposals, shared or external Property Bundles, and other functionality described in the Service.

If you cancel or stop paying for a Professional subscription, Bundle may restrict access to the relevant Professional features, shared or external Property Bundles, Archive Copies, uploads, or Update Proposals, subject to these Terms and any notice shown in the Service.

Subscribing to access additional Properties does not necessarily mean you are using Bundle in trade. Where you use Bundle for genuinely personal or domestic purposes, your rights under the Consumer Guarantees Act 1993 continue to apply notwithstanding any Professional subscription.

7. Account Transfers

You may transfer a Property by providing the recipient’s name and email through the Service. A transfer of a Property transfers control of the digital record within the Service, including its Property Record. It does not transfer legal ownership of the real-world property.

You are responsible for ensuring you have authority to transfer the Property Bundle and that the recipient information is accurate. The new Owner must accept these Terms to complete the transfer.

A transfer that is not claimed by the recipient expires after the period shown in the Service (currently 90 days). An expired transfer does not change control of the Property, and you may initiate a new transfer through the Service.

  • If you are an Owner, your access ends once the transfer is complete.
  • If you are a Professional, the transfer results in the Owner controlling the live Property Bundle. If you elect to retain an Archive Copy, Bundle will also make a separate archive record available under your account for record-keeping.

An Archive Copy is a separate, stand-alone record. Changes made to the Owner's Property Bundle do not affect the Archive Copy, and changes made to the Archive Copy do not affect the Owner's Property Bundle, except through specific Service features such as Update Proposals.

When a Property Bundle is transferred, the Property Record transfers with it, including records marked private. Before initiating or completing a transfer, the transferring user is responsible for reviewing the Property Record and checking that it is appropriate to transfer all included records.

For Professional-to-Owner transfers, any Archive Copy reflects the Property Record at or around the time of transfer, including record metadata and privacy settings where applicable. After transfer, the Owner’s Property Bundle and the Professional’s Archive Copy are separate records and may be managed independently.

Uploads the Professional makes to their Archive Copy after transfer may be offered as Update Proposals under §4.2B. These proposals are optional for the Owner and any Admins to accept and never modify the Owner’s Property Record without acceptance. The Professional is not informed of the decision.

Archive Copies must be elected during the transfer process and require an active Professional subscription. If you do not elect to retain an Archive Copy before completing the transfer, Bundle is not responsible for creating, recovering, or reconstructing an Archive Copy for you later.

8. Warranties and Liability

8.1 Service "As Is"

The Service is provided "as is" without warranties of any kind. We don't warrant that the Service will:

  • Meet all your specific requirements
  • Be error-free or uninterrupted
  • Produce accurate AI outputs in all cases

8.2 Limitation of Liability

To the maximum extent permitted by law:

  • We're not liable for decisions you make based on Service information
  • We exclude liability for indirect, consequential, or incidental damages, including any loss of data
  • You are responsible for maintaining additional independent backups of critical documents.
  • Our total liability is limited to fees paid in the preceding 12 months

8.3 Consumer Rights

Nothing in these Terms excludes or limits rights you have under consumer protection laws that cannot be waived.

8.4 Indemnification

You agree to indemnify Bundle against claims arising from:

  • Your use of the Service in violation of these Terms
  • Your data infringing third-party rights
  • Your failure to obtain necessary consents for uploaded content

9. Termination

9.1 Account Closure

To close your account, contact us at support@mybundle.app. We believe property records have long-term value for all future Owners, and encourage you to keep them, but we respect your right to deletion. You may request deletion of your data, and we will process verified requests within 30 days (see our Privacy Policy).

9.2 Termination by Bundle

We may suspend or terminate accounts that:

  • Materially breach these Terms
  • Engage in illegal activities
  • Pose security or operational risks to the Service

9.3 Effect of Termination

Upon account closure:

  • Access to the Service, and any third-party services accessed through Bundle, ceases;
  • All access links will cease to function;
  • You have the right to request deletion of your data;
  • Data you have requested to be deleted will be deleted within 30 days;
  • Anonymised insights derived from usage remain with Bundle; and
  • Some data may be retained longer if required by law or for security, fraud prevention, or auditing.

9.4 Inactive or Orphan Accounts (also see Privacy Policy §5)

If: (a) an account has no verified contact details; (b) a transfer has been initiated but remains unclaimed and the account is otherwise inactive; (c) any required fees are unpaid; or (d) there has been no sign-in or other activity for 12 months, we may classify the account as inactive or orphaned. We reserve the right to suspend access and, after giving at least 30 days’ notice to the last known contact, delete the account and associated content or anonymise it. We are not liable for any loss resulting from such deletion or anonymisation. We may retain minimal records as required by law or for security, fraud prevention, or auditing purposes.

We believe property records have lasting value for existing and future Owners. Before deleting, consider:

  • Transferring your Property to a new Owner (can increase potential sale and property value). Keeping records accessible helps with warranties and insurance claims.
  • Future you might need these records for tax or legal purposes.
  • Keeping an inactive account with your property history may be available without charge, depending on the Service settings you use and applicable pricing at the time.

10. Dispute Resolution

10.1 Contact Us First

Most issues can be resolved quickly. Before taking formal action, please contact us at support@mybundle.app. We're committed to finding solutions.

10.2 Good Faith Discussion

If we can't resolve any issues informally, both parties agree to meet (virtually or in person) for good faith discussions within 30 days of written notice.

10.3 Mediation

For disputes over $10,000, either party may require mediation before court proceedings. Mediation will be in Auckland under AMINZ rules, with costs shared equally.

10.4 Court Proceedings

If mediation fails or doesn't apply, disputes will be resolved in New Zealand courts. For claims under $30,000, the Disputes Tribunal may be used.

11. General Provisions

11.1 Governing Law

These Terms are governed by New Zealand law. New Zealand courts have exclusive jurisdiction over disputes.

If you access the Service from outside New Zealand, you are responsible for complying with local laws.

11.2 Entire Agreement

These Terms and our Privacy Policy constitute the complete agreement between us. Additional terms may apply to specific features or user types.

11.3 Severability

If any provision is found invalid, the remaining Terms continue in full effect.

11.4 Assignment

You may not assign these Terms without our consent. We may assign our rights in connection with a business transfer.

11.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, government action, internet outages, or acts of third parties.

11.7 Survival of Terms

The provisions relating to limitation of liability, indemnity, intellectual property, data ownership, and governing law will continue to apply after these Terms end.

12. Professional and Commercial Use

If you use Bundle for professional or commercial purposes, activate a Professional subscription, access more than one shared or external Property Bundle, or elect to retain an Archive Copy during a transfer, the Professional Services Addendum applies in addition to these Terms.

If you use Bundle in a professional capacity, you acknowledge that Bundle treats your use as commercial, that you may be subject to different plans, fees, and account treatment, and that Bundle may create separate copies or records tied to your professional obligations. Misstating your relationship to a property may affect your access rights and data retention responsibilities.

If you are a Professional user you are responsible for ensuring you have authority to provide any personal information you upload to Bundle. To the extent we process personal information on your behalf in providing the Service, you remain responsible for compliance with your legal obligations as the agency/controller.

Professional Services Addendum

This Professional Services Addendum ("Addendum") supplements the Bundle Terms of Use for professionals using Bundle in connection with their services.

1. Professional Use

1.1 Who This Applies To

You are a Professional if you use Bundle in a business, trade, or professional capacity — for example as a builder, tradesperson, property manager, real estate agent, or other property service provider.

The Service will prompt you to opt in to a Professional subscription before any action that requires one; subscribing does not by itself mean you are using Bundle in trade, and where your use is genuinely personal or domestic your Consumer Guarantees Act 1993 rights continue to apply.

By activating a Professional subscription, electing to retain an Archive Copy, or continuing to use Professional features, you agree to this Addendum.

1.2 Same Platform, Different Context

You access the same Bundle features as any user, but with different responsibilities when creating properties or accounts for clients. Sections 2 and 3 (Account Creation, Authority, and Handover) apply only where you create a Property or transfer one to an Owner. Where your Professional status arises only from your use of the Service — for example, accessing more than one shared or external Property — the obligations in those sections apply only to the extent relevant to what you actually do.

2. Account Creation and Authority

2.1 Client Authorisation

Before creating any Property Bundle, you warrant that you have:

  • Authorisation from the real-world property owner
  • Authority to accept Bundle's Terms on behalf of the real-world property owner
  • Disclosed that property data will be stored on Bundle and that control of the Property will be transferred to the real-world property owner at handover.

2.2 Responsibility When you create a Property Bundle:

  • You control the Property until it is transferred to the real-world property owner
  • You are responsible for complying with Bundle's Terms in relation to the Property while you control it.
  • Some responsibilities, including those relating to any Archive Copy you retain and to records you were required to keep, continue after handover.

3. Account Handover

3.1 Transfer Process

You agree to transfer the Property to the Owner when required or requested by using Bundle's transfer feature.

3.2 Post-Handover Access

After transfer, you no longer control or have access to the Owner’s Property unless the Owner grants you access through the Service. Any further access is at the Owner’s discretion and subject to the role and permissions they assign.

3.3 Archive Copies and Update Proposals

When you transfer a Property to its Owner, you may elect to retain an Archive Copy for your record-keeping obligations, provided you created the relevant Property and have an active Professional subscription. If you elect to do so during the transfer process, Bundle will make an Archive Copy available under your account reflecting the Property Record at or around the time of transfer.

  • You are responsible for deciding whether you need an Archive Copy before completing a transfer. Archive Copies must be elected during the transfer process and require an active Professional subscription. If you complete a transfer without electing to retain an Archive Copy, Bundle is not responsible for creating, recovering, or reconstructing one for you later.
  • The Archive Copy sits under your account and is not visible to anyone else unless you share access to it. Offering a file as an Update Proposal does not give the Owner access to your Archive Copy.
  • It does not automatically synchronise with, or share content to, the Owner’s version.
  • You may use it for compliance or record-keeping purposes in line with your professional obligations.
  • Archive Copies function as standalone property records within your account. You may use Bundle’s standard sharing and access features for these records, but you remain solely responsible for managing access and ensuring that any sharing complies with your professional and privacy obligations.
  • You are responsible for managing any personal information within the Archive Copy, including reviewing whether it remains required for your legal or record-keeping obligations. Where deletion tools are available, you are responsible for using them when information is no longer required. Where deletion is not available through the Service, you may contact Bundle to request assistance.
  • After handover, you may upload new files to an Archive Copy. Uploading does not by itself make the files available to the new Owner. You may separately offer files from your Archive Copy to the Owner as "Update Proposals", choosing individually which files to offer. You cannot modify or delete anything in the Owner’s Property Record (unless invited to have access), and you do not receive notification of whether your proposal was accepted or declined.

4. Data and Records

4.1 Your Uploads

Documentation you upload remains subject to your professional obligations and industry requirements.

4.2 Long-term Access

Archive Copies may assist you in meeting record-keeping or statutory obligations (for example under the Building Act). Continued access to an Archive Copy depends on your Bundle account, applicable subscription, and these Terms. Any further access to the Owner’s Property after transfer depends on the Owner granting you access. Any re-sharing of personal information from an Archive Copy remains your responsibility and must comply with your professional, privacy, and legal obligations.

4.3 Personal Information

If you upload personal information about others, you warrant that you have the authority to do so. We process such personal information on your behalf solely to provide the Service. You remain responsible for compliance with your legal obligations as the agency/controller.

For Archive Copies retained when you transfer a Property, you are the agency/controller of all personal information within that copy. You must comply with the Privacy Act 2020 for any access, correction, or deletion requests relating to your Archive Copies.

4.4 Update Proposals

You acknowledge and agree that:

  • the Owner or authorised Admin may accept, decline, or ignore proposals;
  • you will not be notified of their decision;
  • a proposal does not give you rights over the Owner’s data; and
  • you remain responsible for retaining your own records as required under your professional and statutory obligations, regardless of whether an Owner or authorised Admin accepts any proposal

5. Commercial Terms

5.1 Payment

You must subscribe to the Professional billing product applicable to your use context where required by the Service or our pricing page.

Professional subscription fees apply to your Professional account. If you elect to retain an Archive Copy, continued access to Professional features, including Archive Copies and Update Proposals, may require an active Professional subscription.

Fees, renewals, cancellations, and any future billing products are described in the Service, on our pricing page, or in the applicable billing terms. No partial-period refunds apply, except where required by law or expressly stated in the Service or applicable billing terms.

5.2 Commercial Relationship

Where you use Bundle in trade, the Consumer Guarantees Act 1993 does not apply. Subscribing to a Professional plan solely to access additional Properties for personal or domestic purposes may not, by itself, constitute use in trade.

6. Liability

6.1 Your Professional Obligations

Bundle does not change your professional obligations. You remain responsible for:

  • Accuracy of your documentation
  • Meeting industry standards
  • Professional advice you provide
  • Meeting your statutory obligations

6.2 Additional Indemnity

Beyond the standard Terms, you indemnify Bundle against claims arising from:

  • Unauthorised account creation
  • Unauthorised property creation
  • Your professional services
  • Failure to obtain proper consent
  • Any use, disclosure, or retention of data within an Archive Copy contrary to privacy or retention obligations.

7. Termination

This Addendum applies whenever you use Bundle professionally. Your obligations regarding existing accounts survive even if you stop using Bundle.
